1. Agreement to terms
By creating an account or using any part of Disfora ("we," "us," "our"), including the website at disfora.com ("Website"), the embeddable commenting widget, the dashboard, and related APIs (collectively, the "Service"), you agree to be bound by these Terms of Service ("Terms"). If you are using the Service on behalf of an organization, you represent that you have authority to bind that organization to these Terms.
If you do not agree to these Terms, you must not use the Service.
2. Accounts
2.1 Registration. To use certain features of the Service, you must create an account by providing a valid email address, username, and password. You agree to provide accurate and complete information and to keep it up to date.
2.2 Security. You are responsible for maintaining the confidentiality of your login credentials and for all activity that occurs under your account. You must notify us immediately at [email protected] if you suspect unauthorized access.
2.3 One account per person. Each individual may maintain one account. Creating multiple accounts to abuse free trials, circumvent bans, or manipulate reputation scores is prohibited.
3. The Service
3.1 Description. Disfora provides an embeddable commenting and reputation platform. Site owners ("Project Owners") create projects, configure the widget, and moderate discussions. Visitors ("Commenters") create accounts to post comments and build reputation ("Clout") across all sites using Disfora.
3.2 Availability. We strive to keep the Service available but do not guarantee uninterrupted access. We may perform maintenance, deploy updates, or experience outages. We will make reasonable efforts to notify users of planned downtime.
3.3 Changes to the Service. We may modify, add, or remove features at any time. If a change materially reduces the functionality of a paid plan, we will provide reasonable notice.
4. Billing and payments
4.1 Plans. The Service offers paid subscription plans (Hobby, Pro) billed monthly per project, and a one-time Lifetime plan per project. Current pricing is displayed on the pricing page.
4.2 Payment processing. Payments are processed by our third-party payment processor. By subscribing, you authorize us to charge your payment method on a recurring basis at the applicable rate. You agree to keep your payment information current.
4.3 Billing cycle. Monthly subscriptions are billed in advance on the same date each month. If you add or upgrade a project mid-cycle, we will charge a prorated amount for the remainder of the current billing period.
4.4 Failed payments. If a payment fails, we will retry up to three times over approximately 72 hours. If all attempts fail, your subscription will be suspended and your projects will be deactivated until payment is resolved.
4.5 Taxes. Prices do not include taxes. You are responsible for any applicable taxes based on your location.
4.6 Lifetime plan. The Lifetime plan is a one-time payment per project that grants permanent access to the Service for that project. Lifetime plans are non-transferable between projects. Access continues indefinitely as long as the Service operates. We reserve the right to revoke Lifetime plan access if the account or project is used for abusive, fraudulent, or otherwise wrongful purposes.
5. Free trial
5.1 Eligibility. New users may be eligible for a 7-day free trial. Trial eligibility is limited to one trial per email address, regardless of account changes.
5.2 Trial terms. During the trial period, you have full access to the features of your selected plan. A valid payment method is required to start the trial. You will not be charged during the trial period.
5.3 After the trial. At the end of the trial, your subscription will automatically convert to a paid subscription at the applicable rate. If you do not wish to continue, you must cancel before the trial ends.
6. Cancellation and refunds
6.1 Cancellation. You may cancel your subscription at any time from the billing page in your dashboard. Upon cancellation, your access continues until the end of the current billing period. No further charges will be made after cancellation.
6.2 Refunds. Monthly subscription payments are non-refundable. If you cancel mid-cycle, you retain access until the end of the paid period but will not receive a prorated refund. For Lifetime plan purchases, we offer a full (100%) refund if requested within 7 days of purchase. After 7 days, we offer a 50% refund.
6.3 Reactivation. You may reactivate a cancelled subscription at any time before the current period ends. After the period ends, you will need to create a new subscription.
7. Acceptable use
You agree not to use the Service to:
- Post content that is illegal, defamatory, threatening, harassing, obscene, or that infringes on the rights of others.
- Impersonate any person or entity, or misrepresent your affiliation with a person or entity.
- Send spam, bulk messages, or automated content.
- Attempt to manipulate Clout scores through fake accounts, coordinated voting, or other deceptive practices.
- Interfere with the Service's infrastructure, including attempting to bypass rate limits, authentication, or security measures.
- Scrape, harvest, or collect data from the Service using automated means without our written consent.
- Use the Service for any purpose that violates applicable laws or regulations.
We reserve the right to suspend or terminate accounts that violate these rules, with or without notice.
8. User content
8.1 Ownership. You retain ownership of the content you post through the Service. By posting content, you grant Disfora a worldwide, non-exclusive, royalty-free license to host, display, reproduce, and distribute your content solely for the purpose of operating and providing the Service.
8.2 Responsibility. You are solely responsible for the content you post. We do not endorse user-generated content and are not liable for content posted by users.
8.3 Moderation. Project Owners are responsible for moderating content on their projects. We provide moderation tools but do not guarantee that all objectionable content will be removed. We reserve the right to remove content that violates these Terms.
8.4 Content retention. When you delete content (comments, ratings), it is soft-deleted but retained indefinitely to maintain the integrity of discussion threads and reputation scores. If you delete your account, we remove the association between your identity and your content, but the content itself remains. When a Project Owner deletes a project, all content associated with that project is permanently and irreversibly removed.
9. Intellectual property
The Service, including its design, code, branding, documentation, and all related intellectual property, is owned by Disfora and protected by copyright, trademark, and other intellectual property laws. These Terms do not grant you any right to use our trademarks, logos, or branding without prior written consent.
The embeddable widget code is provided for use on your websites as part of the Service. You may not modify, decompile, reverse engineer, or create derivative works from the widget code.
10. Termination
10.1 By you. You may close your account at any time by contacting us at [email protected]. Account closure will cancel any active subscriptions.
10.2 By us. We may suspend or terminate your account if you violate these Terms, if your payment fails and is not resolved, or if we are required to do so by law. Where possible, we will provide notice before termination.
10.3 Effect of termination. Upon termination or account deletion, your right to use the Service ceases immediately. All projects owned by you will be permanently deleted, along with all associated data (comments, ratings, configurations, domains). This action is irreversible and results in complete loss of project data. We may retain certain anonymized data as described in our Privacy Policy.
11. Disclaimer of warranties
THE SERVICE IS PROVIDED ON AN "AS IS" AND "AS AVAILABLE" BASIS WITHOUT WARRANTIES OF ANY KIND, WHETHER EXPRESS, IMPLIED, OR STATUTORY. WE DISCLAIM ALL WARRANTIES, INCLUDING BUT NOT LIMITED TO IMPLIED WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, TITLE, AND NON-INFRINGEMENT. WE DO NOT WARRANT THAT THE SERVICE WILL BE UNINTERRUPTED, ERROR-FREE, OR SECURE.
12. Limitation of liability
TO THE MAXIMUM EXTENT PERMITTED BY LAW, DISFORA AND ITS OFFICERS, DIRECTORS, EMPLOYEES, AND AGENTS SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, INCLUDING BUT NOT LIMITED TO LOSS OF PROFITS, DATA, BUSINESS OPPORTUNITIES, OR GOODWILL, ARISING OUT OF OR RELATED TO YOUR USE OF THE SERVICE, REGARDLESS OF THE THEORY OF LIABILITY.
OUR TOTAL AGGREGATE LIABILITY FOR ALL CLAIMS ARISING OUT OF OR RELATED TO THESE TERMS OR THE SERVICE SHALL NOT EXCEED THE GREATER OF (A) THE AMOUNT YOU PAID US IN THE 12 MONTHS PRECEDING THE CLAIM, OR (B) ONE HUNDRED US DOLLARS ($100).
13. Indemnification
You agree to indemnify, defend, and hold harmless Disfora and its officers, directors, employees, and agents from and against any claims, liabilities, damages, losses, and expenses (including reasonable attorneys' fees) arising out of or related to: (a) your use of the Service; (b) content you post through the Service; (c) your violation of these Terms; or (d) your violation of any third-party rights.
14. Dispute resolution
14.1 Governing law. These Terms are governed by and construed in accordance with the laws of the State of California, United States, without regard to conflict of law principles.
14.2 Informal resolution. Before filing a formal dispute, you agree to attempt to resolve it informally by contacting us at [email protected]. We will attempt to resolve the dispute within 30 days.
14.3 Jurisdiction. If informal resolution fails, any legal action shall be brought exclusively in the state or federal courts located in San Francisco County, California. You consent to the personal jurisdiction of these courts.
15. Changes to these Terms
We may update these Terms from time to time. When we make material changes, we will update the "Last updated" date at the top of this page and notify you by email or through the Service. Your continued use of the Service after the updated Terms become effective constitutes acceptance. If you do not agree to the updated Terms, you must stop using the Service and cancel your subscription.
